SERVICE OF PROCESS & JURISDICTION NOTICE

This Service of Process & Jurisdiction Notice (“Notice”) explains the only valid methods and forums for bringing legal claims against Division (“Company,” “We,” or “Us”).

By accessing or using any Division website, Software, loader, digital key, Discord server, or related service (collectively, the “Services”), You (“User”) agree to the jurisdictional and procedural rules set out below.


1. GOVERNING LAW

1.1 All Division policies, including but not limited to the Terms of Service, Privacy Policy, End User License Agreement (EULA), Legal Disclaimer, Affiliate Agreement, DMCA Policy, and these Notices, are governed exclusively by the laws of Singapore.

1.2 Division does not consent to the application of any foreign law, including but not limited to the laws of the United States, European Union member states, or Sweden, except where expressly required under Singapore conflict-of-law rules.


2. EXCLUSIVE JURISDICTION & ARBITRATION

2.1 Any dispute, claim, or controversy arising out of or relating to the Services, Division’s policies, or any interaction with Division shall be resolved by binding arbitration seated in Singapore.

2.2 Arbitration shall be conducted in English under Singapore arbitration rules or procedures designated by Division at its discretion.

2.3 Users expressly waive:

  • The right to file or maintain a lawsuit in any court other than a competent court in Singapore

  • The right to participate in any class action, collective action, or group litigation against Division

  • The right to seek adjudication in foreign courts for claims relating to Division or the Services

2.4 Singapore courts retain exclusive jurisdiction to:

  • Enforce arbitration awards

  • Grant interim or injunctive relief

  • Resolve questions of arbitrability where necessary


3. SERVICE OF PROCESS REQUIREMENTS

3.1 Division does not accept service of process:

  • By email

  • By Discord or any other messaging platform

  • Via social media

  • Through website contact forms

  • Through hosting providers, payment processors, domain registrars, or third-party vendors

3.2 Any attempt to serve legal documents by electronic means is invalid and void unless explicitly permitted by a Singapore court order.

3.3 Proper service of process must comply strictly with:

  • The rules of civil procedure in Singapore, and

  • Any applicable international treaty or convention governing cross-border service of process

3.4 Foreign claimants must use proper international channels (such as treaty-based service mechanisms where applicable) to effect valid service in Singapore. Attempts to bypass or ignore these rules are not recognized by Division.


4. NON-RECOGNITION OF FOREIGN PROCEEDINGS

4.1 Division does not voluntarily recognize:

  • Default judgments entered by foreign courts

  • Subpoenas, discovery requests, or warrants issued by foreign authorities

  • Administrative demands from foreign agencies or regulators

4.2 Any foreign judgment or order must first be properly recognized and, where applicable, domesticated or enforced through a competent Singapore court before Division will treat it as binding.

4.3 Division reserves all rights to contest jurisdiction, validity, enforceability, or recognition of any foreign order.


5. DMCA, COPYRIGHT, AND CONTRACTUAL NOTICES VS. SERVICE

5.1 Submission of a copyright or DMCA-style notice to Division does not constitute valid service of process.

5.2 Contractual disputes, publisher demands, or Terms of Service claims addressed to Division’s email or support channels:

  • Are treated as informal communications only, and

  • Do not satisfy any requirement for valid legal service or initiation of proceedings

5.3 Legal actions must be commenced and served according to Singapore procedural law, regardless of any prior correspondence.


6. PROHIBITED CLAIMANTS & JURISDICTIONS

6.1 Division does not consent to jurisdiction in, and does not provide Services to, Users located in or acting from Sweden. Claims asserted from or based in Sweden are contractually barred.

6.2 Division further does not consent to jurisdiction in any forum by:

  • Employees, contractors, or affiliates of game publishers associated with Rust, Arc Raiders, Fortnite, Apex Legends, DayZ, or Dead by Daylight

  • Employees, contractors, or affiliates of any anti-cheat provider

  • Individuals acting in investigative, enforcement, or evidentiary capacities

Any such claims are contractually foreclosed and are subject to immediate jurisdictional objection.


7. ACCEPTANCE OF THIS NOTICE

By accessing or using any Division Services, You acknowledge and agree that:

  • All disputes must be resolved under Singapore law

  • Arbitration in Singapore is the exclusive dispute resolution mechanism

  • Service of process must follow Singapore procedural rules

  • Electronic or foreign service attempts are invalid unless recognized by a Singapore court


8. RESERVATION OF RIGHTS

Division reserves all rights under:

  • The laws of Singapore

  • Applicable international frameworks

  • All contractual terms set out in Division’s other policies and agreements

Nothing in this Notice waives any defense, right, or objection available to Division.
